Brinker Wins Defense Verdict in Medical Malpractice Trial

Following a lengthy jury trial, Jeff Brinker won a defense verdict in a medical malpractice trial on behalf of an emergency medicine physician and an urgent care clinic. Plaintiff had alleged Defendants treated her daughter negligently by failing to suspect, work up, and treat a pulmonary embolism, which ultimately led to her death several weeks later. Contrary to Plaintiff’s allegations, experts in emergency medicine and pulmonology explained that Decedent had presented with such a low suspicion for pulmonary embolism that additional treatment was unnecessary, and also that it could not be proven to a reasonable degree of medical certainty such an embolism existed during the treatment at issue. After deliberating for several hours, jurors returned a verdict for both the physician and urgent care clinic.
