Fields Earns Dismissal of Illinois Suit

Stephen Fields won dismissal of a personal injury case in St. Clair County, Illinois on the basis of a unique Illinois statute of limitations which governs lawsuits against public entities. Plaintiff, whose elderly father had been a passenger in a bus operated by a transportation service, sued the college which administered the transportation service for having driven the bus after her father allegedly slipped from his seat. Because defendant was a community college, Fields argued to the court that the correct statute of limitations was one designed for application to public entities – including community colleges – and that plaintiff’s suit, which was brought after the expiration of that unique statute, was thus time-barred. A St. Clair County judge agreed, and the case was dismissed while still in the early stages of written discovery.
